AI and Academia: A Wild West of Rules – An Education Lawyer Discusses

As I’ve noted in some of my other posts, AI is becoming one of the more frequent academic integrity accusations that I have seen students being accused of. This is a trend that I see continuing. While there is not one single rule by which colleges and universities must treat AI, I am seeing one trend. Many colleges and universities official stance on AI are “whatever the professor says.” Instead of tackling the issue and coming up with coherent AI policies, what I have seen is that most schools are simply leaving it to the individual professor.

Leaving AI policies up to each professor presents several problems for students, including:

  • Inconsistency. Students are now left with no consistent policy. What a professor in one course may allow could be completely different than another professor, even one in the same department.
  • Unclear Rules. Although many colleges and universities have ceded this responsibility to professors, many professors have not addressed these policies within their own courses. Some do not address AI at all, others may include a throw-away line that they add to their syllabus about “no AI usage is allowed” without defining what they consider AI (is Grammarly AI?).
  • Ignorance. Many professors themselves are completely ignorant of how AI works and how to legitimately determine whether a student is actually using AI or not.

In order to protect yourself as best you can, students can do the following:

  • Is there a policy? Search to see if your college or university has an official AI policy.
  • Read the syllabus. If the university leaves its AI policy up to individual professors, read the professor’s syllabus to see what they say about AI.
  • Ask questions. If after reading the syllabus, you still believe that it is unclear, ask the professor specific questions.
